This Privacy Policy ("Policy") describes how Rain Network, LLC, a Texas limited liability company ("Rain Network," "Rain," "we," "us," or "our"), collects, uses, discloses, retains, and protects personal information through the website located at rainnetwork.com (the "Site") and the services described on it (the "Services").

This Policy applies to all visitors, applicants, managed creators, fans of managed creators (where their data flows through Rain), and any other person who interacts with Rain.

BY ACCESSING THE SITE, SUBMITTING AN APPLICATION, INTERACTING WITH ANY MANAGED CREATOR THROUGH RAIN-MANAGED CHANNELS, OR OTHERWISE ENGAGING WITH RAIN, YOU CONSENT TO THIS POLICY AND THE PRACTICES DESCRIBED HEREIN. IF YOU DO NOT AGREE, YOU MUST IMMEDIATELY CEASE ALL ACCESS AND USE.

This Policy is incorporated into and made part of our Terms of Service. Capitalized terms not defined here have the meanings given in the Terms of Service.

1. Scope, Definitions, and Audiences Covered

This Policy applies to:

  • Visitors who access or view the Site

  • Applicants who submit an inquiry or application to be managed by Rain

  • Managed Creators who have signed a Management Services Agreement with Rain

  • Fans who subscribe to, message, tip, or otherwise interact with a Managed Creator's account to the extent their data passes through Rain-operated tools, dashboards, or third-party service workflows

  • Other Persons who contact Rain, apply for employment, attend an event, or otherwise interact with us

Definitions:

"Personal Information" or "Personal Data" means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household.

"Sensitive Personal Information" ("SPI") includes government-issued identifiers, account login credentials, financial account information, precise geolocation, racial or ethnic origin, religious or philosophical beliefs, union membership, contents of mail, email, and text messages, genetic data, biometric information used to uniquely identify, health information, and sex life or sexual orientation information.

"Process" means any operation performed on Personal Information.

"Service Provider" means a third party that processes Personal Information on Rain's behalf under a written contract.

"Third-Party Service Provider" has the meaning given in the Terms of Service and includes assistants, contractors, agencies, AI tools, and software systems that assist creators with operations.

This Policy does NOT cover:

  • Personal Information collected by third-party Subscription Platforms (OnlyFans, Fansly, or similar) directly from users

  • Personal Information collected by Managed Creators in their independent business operations outside of Rain-operated tools

  • Personal Information collected by social media platforms, payment processors, or other third parties from whom you may interact with Managed Creators or Rain

We have no control over and are not responsible for the privacy practices of third-party platforms or services.

2. Information We Collect

Rain collects Personal Information directly from you, automatically through technology, and from third parties.

Information you provide directly:

  • Contact and account information (name, email address, phone number, mailing address, social media handles, professional title, business name)

  • Application information for Applicants and Creators (stage name, legal name, date of birth, age verification documentation, government-issued identification, photographs, content samples, social media analytics, platform earnings history, audience demographics, niche and content categories, prior agency relationships, references, business entity information, tax identification numbers, banking and payment details)

  • Sensitive Personal Information from Managed Creators (government-issued identification, biometric information for age verification, financial account information, login credentials for platform access, content depicting the individual)

  • Communications (emails, messages, voice or video calls)

  • Survey and feedback information

  • Business and operational information from Creators (content calendars, posting schedules, analytics data, revenue reports, subscriber lists, platform credentials, brand deal terms)

Information collected automatically:

  • Device and connection information (IP address, browser type, browser language, operating system, device type, device identifiers, screen resolution, time zone, internet service provider, referring and exit pages)

  • Usage information (pages viewed, links clicked, time spent, search terms, navigation paths, scroll depth, click patterns, engagement metrics)

  • Approximate geolocation derived from IP address (precise GPS-level geolocation is not collected without explicit opt-in)

  • Cookies and tracking technologies

  • Conversion and marketing attribution data

Information from third parties:

  • Data from Subscription Platforms and social media platforms shared by Creators or accessed under authorization

  • Data from marketing and analytics partners

  • Service Provider data

  • Payment processor transaction information

  • Publicly available social media profiles and business directory information

  • Referrals from existing Creators or others

  • Background verification service results

Information Fans provide when interacting through Rain-managed channels (where Rain or its Third-Party Service Providers support a Managed Creator's account under Backend or Elite tiers):

  • Fan platform usernames and profile information visible on the platform

  • Direct message content (including personal, intimate, or financial information voluntarily shared)

  • Tip, subscription, and purchase amounts and frequencies

  • Fan engagement patterns, spending behavior, content preferences, and retention data

  • Any information Fans voluntarily disclose

IMPORTANT FAN DISCLOSURE: If you are a Fan interacting with a Managed Creator whose account is operationally supported by Rain or its Third-Party Service Providers, your messages, tips, subscriptions, and related interactions may be processed, reviewed, stored, or referenced by Rain and its Third-Party Service Providers (including human contractors and AI systems) under the Creator's direction and authority. By engaging in such interactions, you consent to this processing as described in Section 6 of our Terms of Service. Do not share information you do not consent to being handled by Third-Party Service Providers.

3. How We Use Your Information

We use Personal Information to:

  • Provide and operate the Services (respond to inquiries, provide management services to Managed Creators, operate Subscription Platform accounts under Creator authorization, provide customer service, facilitate payments and revenue reporting, verify identity and age compliance)

  • Communicate with you (transactional communications, marketing communications with opt-in, notices of policy changes, responses to inquiries)

  • Improve and develop the Services (analyze usage patterns, improve functionality, develop new features, conduct research, train Rain's internal operational tools subject to Section 12)

  • Marketing and advertising (send marketing emails with opt-in, conduct marketing campaigns, measure marketing performance, build audience and lookalike segments)

  • Safety, security, and legal compliance (detect fraud and abuse, verify age and identity, enforce the Terms of Service, comply with applicable laws and law enforcement requests, protect rights and safety, establish legal claims, cooperate with regulators)

  • Business operations (corporate governance, accounting, audit, evaluate or complete corporate transactions)

  • With your consent for any other disclosed purpose

  • AI-assisted operations as detailed in Section 12

4. How We Share Your Information

Rain does not sell Personal Information for monetary consideration.

We may share Personal Information with:

  • Service Providers who perform services on our behalf under written contracts requiring confidentiality and security

  • Third-Party Service Providers (operational support for Managed Creators' accounts, as described in Section 6 of the Terms of Service)

  • Managed Creators (Personal Information of Fans, prospects, and other interacting persons to the extent reasonably necessary for Creator business operations)

  • Subscription Platforms and social media platforms (to the extent necessary to access, manage, or operate Creator accounts)

  • Brand partners and advertisers (with the Creator's consent to facilitate engagements)

  • In connection with business transfers (mergers, acquisitions, financings, reorganizations, sales of assets, bankruptcy)

  • Legal compliance and safety (subpoenas, court orders, regulatory inquiries, legal process, protection of rights and safety, enforcement of Terms, cooperation with law enforcement including reporting CSAM to NCMEC per 18 U.S.C. Section 2258A)

  • With your consent for any other purpose

We may share aggregated, de-identified, or anonymized information that cannot reasonably be linked to you for any business purpose.

SALE AND SHARING FOR CROSS-CONTEXT BEHAVIORAL ADVERTISING: Some state privacy laws (notably the CCPA/CPRA in California) define "sale" and "sharing" broadly to include certain disclosures of Personal Information to third parties for cross-context behavioral advertising. To the extent Rain participates in advertising programs that involve such disclosures, this activity may constitute "sale" or "sharing" under those laws. California and other state residents have the right to opt out as described in Section 8.

RAIN DOES NOT SELL PERSONAL INFORMATION OF ANY PERSON KNOWN TO BE UNDER 18.

5. Cookies, Tracking Technologies, and Analytics

Rain and our Service Providers use cookies, web beacons, pixels, local storage, software development kits, mobile device identifiers, and similar technologies to authenticate users, remember preferences, analyze Site performance, measure marketing effectiveness, personalize content and advertising, and detect and prevent fraud.

Cookie categories:

  • Strictly necessary cookies (for authentication, security, load balancing)

  • Functional cookies (preferences and settings)

  • Analytics cookies (Google Analytics, Vercel Analytics)

  • Marketing and advertising cookies (Meta Pixel, Google Ads tags, TikTok pixel)

Third-party trackers operate under their own privacy practices.

Your choices:

  • Adjust browser settings to refuse cookies

  • Opt out of advertising cookies through industry tools (NAI: optout.networkadvertising.org, DAA: optout.aboutads.info, EDAA: youronlinechoices.eu)

  • Use Global Privacy Control (GPC) signals, which Rain honors as an opt-out of "sale" and "sharing" under CCPA where applicable

  • Adjust mobile device settings to limit ad tracking

The Site does not respond to most browser-based "Do Not Track" signals because there is no industry consensus on how to interpret them. We do honor GPC signals.

6. Data Retention

We retain Personal Information only for as long as necessary to fulfill the purposes described in this Policy, comply with our legal obligations, resolve disputes, enforce our agreements, and protect against fraud and abuse.

  • Inquiry and application data: Retained for up to 24 months after last contact unless you become a Managed Creator

  • Managed Creator data: Retained for the duration of the engagement and for 7 years after termination (or longer if required by tax, accounting, or legal obligations)

  • Fan interaction data routed through Rain-operated tools: Retained for the period the Creator's account is supported plus a reasonable wind-down period, subject to platform requirements

  • Tax, accounting, and financial records: Retained for at least 7 years

  • Communications: Retained for up to 7 years for legal, audit, and compliance purposes

  • Site analytics: Retained in identifiable form for up to 26 months and aggregated indefinitely

  • Marketing data: Retained until you unsubscribe or for 24 months of inactivity

  • Information subject to legal hold or pending claims: Retained until resolution

When Personal Information is no longer needed, we securely delete, anonymize, or aggregate it.

7. Data Security

Rain implements reasonable administrative, technical, and physical safeguards designed to protect Personal Information from unauthorized access, use, disclosure, alteration, or destruction, including:

  • Encryption in transit (TLS) and at rest where reasonably feasible

  • Access controls and least-privilege permissions

  • Multi-factor authentication for sensitive systems

  • Regular security reviews and penetration testing

  • Confidentiality agreements with employees and Service Providers

  • Incident response procedures

However, no method of transmission over the internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect Personal Information, we cannot guarantee absolute security. You acknowledge that you transmit information to us at your own risk.

If we become aware of a security incident that affects your Personal Information in a manner requiring notification under applicable law, we will notify you and applicable authorities as required.

You are responsible for maintaining the security of your account credentials and for any activity that occurs under your account. Notify us immediately at security@rainnetwork.com of any suspected unauthorized access.

8. Your Privacy Rights

Depending on your jurisdiction, you may have certain rights regarding your Personal Information.

UNIVERSAL RIGHTS WE HONOR FOR ALL USERS:

  • Access (request information about Personal Information we hold)

  • Correction (request correction of inaccurate or incomplete information)

  • Deletion (request deletion subject to exceptions for legal, accounting, audit, and compliance retention)

  • Opt-Out of Marketing (unsubscribe via the unsubscribe link or by emailing privacy@rainnetwork.com)

  • Withdraw Consent (where processing is based on consent)

CALIFORNIA RESIDENTS (CCPA/CPRA):

  • Right to Know

  • Right to Correct

  • Right to Opt Out of Sale and Sharing for cross-context behavioral advertising

  • Right to Limit Use of Sensitive Personal Information

To exercise these rights, contact privacy@rainnetwork.com with "California Privacy Rights Request" in the subject line. Our "Do Not Sell or Share My Personal Information" mechanism is available by sending a request or configuring your browser to send a GPC signal.

TEXAS RESIDENTS (TDPSA):

  • Right to Confirm Processing and access

  • Right to Data Portability

  • Right to Opt Out of targeted advertising, sale of Personal Data, and profiling in furtherance of decisions producing legal or similarly significant effects

We will respond within 45 days (extendable by 45 additional days). If we deny your request, you may appeal by emailing privacy-appeals@rainnetwork.com.

OTHER STATE RESIDENTS (Virginia, Colorado, Connecticut, Utah, Oregon, Montana, Iowa, Tennessee, Delaware, Indiana, New Hampshire, New Jersey, Nebraska, Maryland, Kentucky, Minnesota, Rhode Island, and other states with comprehensive privacy laws): Rights to access, correct, delete, port, and opt out of sale/sharing or targeted advertising similar to those above.

EUROPEAN RESIDENTS (GDPR / UK GDPR):

CALIFORNIA SHINE THE LIGHT ACT: California Civil Code Section 1798.83 permits California residents to request information about disclosures of Personal Information to third parties for direct marketing purposes.

Verification and limitations: To verify your identity, we will require reasonable proof. You may use an authorized agent. We may decline rights requests where we cannot verify identity, the request is manifestly unfounded, excessive, or repetitive, compliance would violate the rights of others, compliance is prohibited by law, or an exception applies.

9. Children's Privacy (Strict 18+)

The Site, the Services, and Rain's business are strictly limited to adults eighteen (18) years of age or older. Rain does not knowingly collect, solicit, or store Personal Information from anyone under eighteen. Rain does not knowingly contract with, manage, market for, or accept applications from anyone under eighteen.

If you are under eighteen, you must not access the Site, submit information, or interact with any Managed Creator through Rain channels.

If we become aware that we have collected Personal Information from a person under eighteen, we will promptly delete that information, terminate any associated relationship, and report the matter to applicable authorities where required by law (including reporting CSAM to the National Center for Missing and Exploited Children CyberTipline as required by 18 U.S.C. Section 2258A).

If you are a parent or guardian and believe your child has provided Personal Information to Rain, contact us immediately at safety@rainnetwork.com.

10. International Data Transfers

Rain is based in the United States, and our Service Providers and operations may be located in the United States and other countries. If you access the Site or use the Services from outside the United States, your Personal Information may be transferred to, stored in, and processed in the United States or other jurisdictions where Rain or its Service Providers operate. The data protection laws in those jurisdictions may differ from the laws of your country.

By using the Services, you consent to the transfer of your Personal Information to the United States and other jurisdictions.

For transfers from the European Economic Area, the United Kingdom, or Switzerland, we rely on appropriate legal mechanisms such as Standard Contractual Clauses or other lawful transfer mechanisms.

11. Sensitive Personal Information and Biometric Information

Rain may collect Sensitive Personal Information ("SPI") from Managed Creators and Applicants including government-issued identification, biometric information used for age verification, financial account information, login credentials for platform access, and content that may depict the individual.

Rain processes SPI only for purposes strictly necessary to:

  • Verify age and identity to enforce the 18+ requirement

  • Provide the Services as agreed in the MSA

  • Comply with legal obligations including 18 U.S.C. Section 2257-related record-keeping requirements where applicable to the Creator

  • Prevent fraud and verify legitimacy

  • Defend legal claims

Rain does not use SPI for marketing, advertising, profiling, or any purpose beyond those listed.

BIOMETRIC INFORMATION: Where we collect biometric information (such as facial recognition results for age verification), we do so under contracts with reputable identity verification providers. Biometric information is retained only for as long as necessary for the verification purpose and is deleted thereafter, subject to legal retention requirements.

  • Texas residents: Rain complies with the Texas Capture or Use of Biometric Identifiers Act, Tex. Bus. and Com. Code Section 503.001

  • Illinois residents: Rain complies with the Illinois Biometric Information Privacy Act, 740 ILCS 14, where applicable

  • California residents have the right to limit the use of SPI as described in Section 8

12. Artificial Intelligence and Automated Processing

Rain and its Third-Party Service Providers may use artificial intelligence systems, machine learning models, and large language models in operations including:

  • Drafting, editing, and suggesting messages, captions, posts, and replies for Managed Creator accounts (with human oversight)

  • Analyzing audience and engagement data to inform strategy

  • Automating routine customer service responses

  • Detecting fraud and policy violations

  • Optimizing advertising performance and audience targeting

  • Generating creative content variants for Creator approval

Rain does not use automated decision-making, including profiling, to make decisions that produce legal or similarly significant effects concerning you without human review. Decisions regarding application acceptance, contract terms, terminations, or material business outcomes involve human judgment.

Rain does not sell Personal Information to AI providers for training their general models. Where we use AI tools provided by third parties (such as OpenAI, Anthropic, or similar), we operate under enterprise agreements that contractually restrict the use of our data for third-party model training to the extent commercially available.

Fan communications and AI: As disclosed in Section 6 of the Terms of Service, communications on Subscription Platforms may be composed or assisted by AI tools operating under the Creator's direction. By interacting with a Managed Creator's account, you consent to this practice.

Where you have rights under applicable law to object to profiling or automated processing, you may exercise those rights as described in Section 8.

13. Marketing Communications (CAN-SPAM, TCPA)

Email marketing: We send marketing emails only to recipients who have opted in or have an existing business relationship with us. All marketing emails include an unsubscribe link. To unsubscribe, click the link or email privacy@rainnetwork.com. We comply with the CAN-SPAM Act, 15 U.S.C. Section 7701 et seq.

Text message marketing: We send marketing text messages only with your prior express written consent as required by the Telephone Consumer Protection Act, 47 U.S.C. Section 227. Standard message and data rates may apply. Reply STOP to unsubscribe. Reply HELP for help. Frequency varies. You can withdraw consent at any time.

Phone calls: Marketing phone calls are made only in compliance with the TCPA and Do Not Call rules.

Transactional communications: Even if you opt out of marketing, we may still send transactional communications related to your account, application, services, or legal notices.

14. Third-Party Links, Platforms, and Services

The Site may contain links to third-party websites, platforms, applications, or services. We do not control and are not responsible for the privacy practices of those third parties.

Subscription Platforms, social media platforms, payment processors, and other third-party services have their own privacy policies. We strongly encourage you to review the privacy policy of every third party with whom you share Personal Information.

References on the Site to media outlets, news publications, or other press are descriptive only and do not constitute endorsements or partnerships, and the privacy practices of those outlets are not governed by this Policy.

15. Data Breaches

In the event of a data breach affecting your Personal Information, we will notify you and applicable authorities as required by applicable law (including state breach notification laws and the GDPR where applicable).

We are not liable for breaches caused by your own conduct, your failure to secure your account credentials, or events outside our reasonable control.

16. Changes to This Privacy Policy

We may update this Policy from time to time. When we do, we will revise the "Last Updated" date at the top of the Policy. For material changes, we will provide additional notice (such as a banner on the Site or an email notification).

Your continued use of the Site or Services after a revised Policy becomes effective constitutes acceptance of the revised Policy. If you do not agree, you must cease use.

We will not apply material changes retroactively in a manner that diminishes your rights regarding Personal Information already collected without your consent.

17. No Reliance and Integration

This Policy, together with our Terms of Service and any signed Management Services Agreement, constitutes the complete agreement regarding the collection, use, and disclosure of Personal Information.

You acknowledge that you have not relied on any statement, representation, or communication outside this Policy and the Terms of Service in deciding to interact with Rain. No oral statement, marketing communication, social media post, or other extra-contractual statement modifies this Policy.

In case of conflict between this Policy and the Terms of Service regarding processing of Personal Information, this Policy controls.

18. Liability Limitations, Disclaimers, and Dispute Resolution

LIMITATION OF LIABILITY: TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RAIN'S LIABILITY ARISING OUT OF OR RELATED TO THIS POLICY OR OUR PROCESSING OF PERSONAL INFORMATION IS SUBJECT TO THE LIMITATIONS SET FORTH IN SECTION 16 OF OUR TERMS OF SERVICE.

DISCLAIMERS: WITHOUT LIMITING THE WARRANTY DISCLAIMERS IN OUR TERMS OF SERVICE, RAIN DISCLAIMS ALL WARRANTIES REGARDING THE SECURITY, ACCURACY, OR COMPLETENESS OF DATA PROCESSING TO THE FULLEST EXTENT PERMITTED BY LAW.

INDEMNIFICATION: Your indemnification obligations under Section 10 of our Terms of Service apply to claims arising from your provision of inaccurate, incomplete, or misleading information, your violation of this Policy, your provision of Personal Information about other persons without proper authorization, or your unauthorized use of Personal Information you obtain through the Services.

DISPUTE RESOLUTION: Any dispute, claim, or controversy arising out of or relating to this Policy is subject to the dispute resolution provisions of our Terms of Service, including the mandatory informal dispute resolution requirement in Section 18 and the binding individual arbitration and class action waiver in Section 19.

GOVERNING LAW: This Policy is governed by the laws of the State of Texas, without regard to its conflicts of laws principles. To the extent any state or country's privacy law provides you with additional rights, those rights are recognized to the extent required by law.

  • Personal Information collected by Managed Creators in their independent business operations outside of Rain-operated tools.

  • Personal Information collected by social media platforms, payment processors, or other third parties from whom you may interact with Managed Creators or Rain.

We have no control over and are not responsible for the privacy practices of third-party platforms or services. We strongly encourage you to review the privacy policies of every platform you use.

2. Information We Collect

Rain collects Personal Information in three principal ways: (i) directly from you, (ii) automatically through technology, and (iii) from third parties.

2.1 Information You Provide Directly

We collect Personal Information you voluntarily provide to us, including:

Contact and Account Information: Name, email address, phone number, mailing address, social media handles, professional title, business name, and similar contact details when you fill out a form, apply, subscribe to communications, or otherwise contact us.

Application Information (Applicants and Creators): Stage name, legal name, date of birth, age verification documentation, government-issued identification (driver's license, passport), photographs, content samples, social media analytics, platform earnings history, audience demographics, niche and content categories, prior agency relationships, references, business entity information, tax identification numbers, banking and payment details, and any other information you provide in your application or onboarding.

Sensitive Personal Information: As described in Section 11, when you become a Managed Creator we may collect government-issued identification, biometric information for age verification, financial account information, login credentials for platform access, and content depicting you. We treat this category with heightened protections.

Communications: The contents of emails, messages, voice or video calls, and other communications you send to Rain or to Managed Creators through Rain-operated channels.

Survey and Feedback Information: Information you provide when you respond to surveys, give feedback, or participate in promotions.

Business and Operational Information (Creators): Content calendars, posting schedules, analytics data, revenue reports, subscriber lists (to the extent shared with Rain), platform credentials (where you grant Rain access for operational purposes), brand deal terms, and other business operations data.

2.2 Information Collected Automatically

When you access or use the Site, we and our Service Providers automatically collect certain information through cookies, web beacons, pixels, server logs, and similar technologies:

Device and Connection Information: IP address, browser type, browser language, operating system, device type, device identifiers, screen resolution, time zone, internet service provider, and referring/exit pages.

Usage Information: Pages you view, links you click, time spent on the Site, search terms, navigation paths, scroll depth, click patterns, and engagement metrics.

Geolocation: Approximate geographic location derived from IP address. We do not collect precise GPS-level geolocation through the Site unless you explicitly opt in.

Cookies and Tracking Technologies: See Section 5 for detail on our cookie practices.

Conversion and Marketing Attribution: Information from advertising networks, marketing partners, and referral sources about how you came to the Site, which advertisements you may have seen or clicked, and which campaign you attribute to.

2.3 Information from Third Parties

We may receive Personal Information from third parties, including:

Subscription Platforms and Social Media Platforms: Aggregated and individual analytics, audience data, follower information, engagement metrics, subscription and revenue data shared by Creators or accessed under authorization granted by Creators.

Marketing and Analytics Partners: Information about how you interact with our marketing, advertising performance data, and audience insights.

Service Providers: Service Providers may share information collected on our behalf.

Payment Processors: Transaction information including amounts, dates, and identifiers (we do not store full credit card numbers).

Public Sources: Publicly available social media profiles, business directories, news articles, and similar public sources where you have an existing public presence.

Referrals: Information provided by referral partners, existing Creators, or others who refer you to Rain.

Background Verification Services: When required for compliance, we may engage background or identity verification services and receive results.

2.4 Information Fans Provide When Interacting Through Rain-Managed Channels

When Rain or its Third-Party Service Providers operate or assist with a Managed Creator's account under the Backend or Elite tiers described in our Terms of Service, the following Fan-related information may pass through Rain-operated tools, dashboards, or workflows:

  • Fan platform usernames, display names, and profile information visible on the platform;

  • Direct message content, including any personal, intimate, or financial information Fans choose to share;

  • Tip, subscription, and purchase amounts and frequencies;

  • Fan engagement patterns, spending behavior, content preferences, and retention data;

  • Any information Fans voluntarily disclose in messages.

Important Fan Disclosure: If you are a Fan interacting with a Managed Creator whose account is operationally supported by Rain or its Third-Party Service Providers, your messages, tips, subscriptions, and related interactions may be processed, reviewed, stored, or referenced by Rain and its Third-Party Service Providers (including human contractors and AI systems) under the Creator's direction and authority. By engaging in such interactions, you consent to this processing as described in Section 6 of our Terms of Service. Do not share information you do not consent to being handled by Third-Party Service Providers.

2.5 Information About Other People That You Share

If you provide Personal Information about another person (e.g., a referral, a contact, a person depicted in your content), you represent and warrant that you have all necessary rights and consents to share that information with Rain and to permit Rain to process it as described in this Policy.

3. How We Use Your Information

We use Personal Information for the following purposes, each tied to a lawful basis under applicable law:

3.1 To Provide and Operate the Services

  • Respond to inquiries, applications, and onboarding requests

  • Provide management services to Managed Creators under signed MSAs

  • Operate Creator subscription platform accounts to the extent authorized by each Creator

  • Provide customer service and technical support

  • Facilitate payments, billing, and revenue reporting to Creators

  • Verify identity and age compliance

3.2 To Communicate with You

  • Send transactional communications (account updates, application status, billing)

  • Send marketing communications where you have opted in

  • Provide notice of changes to these policies or our practices

  • Respond to your inquiries

3.3 To Improve and Develop the Services

  • Analyze usage patterns and user behavior on the Site

  • Improve the Site's functionality, performance, and user experience

  • Develop new features, tools, and services

  • Conduct research, analytics, and product testing

  • Train Rain's internal operational tools (subject to Section 12 below regarding AI)

3.4 For Marketing and Advertising

  • Send marketing emails and promotional content (with opt-in where required by law)

  • Conduct marketing campaigns, including targeted advertising

  • Measure marketing performance and attribution

  • Show you advertisements that may be relevant to you

  • Build audience and lookalike segments for marketing optimization

3.5 For Safety, Security, and Legal Compliance

  • Detect, prevent, investigate, and respond to fraud, abuse, security risks, and unlawful activity

  • Verify age and identity to enforce our 18+ requirement

  • Enforce our Terms of Service and other policies

  • Comply with applicable laws, regulations, court orders, and law enforcement requests

  • Protect the rights, property, and safety of Rain, our Creators, our users, and the public

  • Establish, exercise, or defend legal claims

  • Cooperate with regulators, auditors, and accountants

3.6 For Business Operations

  • Conduct corporate governance, accounting, audit, and reporting

  • Evaluate, structure, or complete corporate transactions (mergers, acquisitions, financings, divestitures, restructurings)

  • Manage our business relationships and contracts

3.7 With Your Consent

  • Any other purpose disclosed to you at the time of collection or for which you provide consent.

3.8 AI and Automated Processing

See Section 12 for detail on how we use Personal Information in AI-assisted operations and automated processing.

4. How We Share Your Information

Rain does not sell Personal Information for monetary consideration. Rain may share Personal Information in the following circumstances:

4.1 With Service Providers

We share Personal Information with Service Providers who perform services on our behalf, including:

  • Cloud hosting and storage providers

  • Email and communications providers

  • Analytics and measurement providers

  • Marketing and advertising platforms

  • Payment processors and financial service providers

  • Identity verification and age verification services

  • Customer support tools

  • Security and fraud prevention services

  • Legal, accounting, audit, and tax advisors

Each Service Provider is contractually bound to process Personal Information only on Rain's behalf, for specified purposes, with confidentiality, and with appropriate security safeguards. Service Providers are not permitted to use Personal Information for their own marketing.

4.2 With Third-Party Service Providers (Operational Support)

As described in Section 6 of our Terms of Service, Managed Creators routinely engage Third-Party Service Providers (including assistants, contractors, agencies, software tools, and AI systems) to assist with subscription platform operations. Personal Information of Fans interacting with those accounts may be processed by these Third-Party Service Providers under the Creator's direction and authority.

This is a material disclosure. By interacting with a Managed Creator's account, you acknowledge and consent to this processing.

4.3 With Managed Creators

We share Personal Information of Fans, prospects, and other interacting persons with the Managed Creators those persons engage with, to the extent reasonably necessary for the Creator's business operations and the services Rain provides.

4.4 With Subscription Platforms and Social Media Platforms

We share Personal Information with the Subscription Platforms and social media platforms on which Managed Creators operate, to the extent necessary to access, manage, or operate those accounts.

4.5 With Business Partners

We may share Personal Information with brand partners, advertisers, and business partners with whom Managed Creators have engagements, to facilitate those engagements, with the Creator's consent.

4.6 In Connection with Business Transfers

If Rain is involved in a merger, acquisition, financing, reorganization, sale of assets, bankruptcy, or similar transaction, Personal Information may be transferred to the successor entity or counterparty. We will provide notice as required by law.

4.7 For Legal Compliance and Safety

We may share Personal Information to:

  • Respond to subpoenas, court orders, regulatory inquiries, and legal process

  • Comply with applicable law

  • Protect the rights, property, or safety of Rain, our Creators, our users, or the public

  • Enforce our Terms of Service and other policies

  • Establish, exercise, or defend legal claims

  • Cooperate with law enforcement (including reporting CSAM to NCMEC per 18 U.S.C. § 2258A)

4.8 With Your Consent

For any other purpose with your consent.

4.9 Aggregated and De-Identified Information

We may share aggregated, de-identified, or anonymized information that cannot reasonably be linked to you, for any business purpose.

4.10 "Sale" and "Sharing" for Cross-Context Behavioral Advertising

Some state privacy laws (notably the CCPA/CPRA in California) define "sale" and "sharing" broadly to include certain disclosures of Personal Information to third parties for cross-context behavioral advertising, even without monetary consideration.

To the extent Rain participates in advertising programs that involve such disclosures (for example, sharing online identifiers with advertising partners for the purpose of serving targeted ads), this activity may constitute "sale" or "sharing" under those laws. California and other state residents have the right to opt out as described in Section 8.

Rain does NOT sell Personal Information of any person known to be under 18.

5. Cookies, Tracking Technologies, and Analytics

5.1 What We Use

Rain and our Service Providers use cookies, web beacons, pixels, local storage, software development kits, mobile device identifiers, and similar technologies to:

  • Authenticate users and maintain sessions

  • Remember preferences and settings

  • Analyze Site performance and usage

  • Measure marketing effectiveness

  • Personalize content and advertising

  • Detect and prevent fraud

5.2 Types of Cookies

  • Strictly Necessary Cookies: Required for the Site to function (authentication, security, load balancing).

  • Functional Cookies: Remember preferences and settings.

  • Analytics Cookies: Help us understand usage patterns (e.g., Google Analytics, Vercel Analytics).

  • Marketing/Advertising Cookies: Used to deliver and measure advertising (e.g., Meta Pixel, Google Ads tags, TikTok pixel).

5.3 Third-Party Trackers

We work with third-party providers that may set their own cookies and trackers when you visit the Site. Their privacy practices are governed by their own policies.

5.4 Your Choices

You can:

  • Adjust your browser settings to refuse, accept, or delete cookies (though refusing strictly necessary cookies may impair Site functionality)

  • Opt out of advertising cookies through industry tools such as the Network Advertising Initiative (optout.networkadvertising.org), Digital Advertising Alliance (optout.aboutads.info), and European Interactive Digital Advertising Alliance (youronlinechoices.eu)

  • Use browser-based privacy controls including Global Privacy Control ("GPC") signals, which Rain will honor as an opt-out of "sale" and "sharing" under the CCPA where applicable

  • Adjust mobile device settings to limit ad tracking

5.5 Do Not Track

The Site does not respond to most browser-based "Do Not Track" signals because there is no industry consensus on how to interpret them. We do honor GPC signals as described above.

6. Data Retention

We retain Personal Information only for as long as necessary to fulfill the purposes described in this Policy, comply with our legal obligations, resolve disputes, enforce our agreements, and protect against fraud and abuse.

Specific retention periods include:

  • Inquiry and application data: Up to 24 months after last contact, unless you become a Managed Creator (in which case retained for the duration of engagement plus the period below).

  • Managed Creator data: Retained for the duration of the engagement and for a period of 7 years after termination (or longer if required by tax, accounting, or legal obligations).

  • Fan interaction data routed through Rain-operated tools: Retained for the period the Creator's account is supported plus a reasonable wind-down period, subject to platform requirements.

  • Tax, accounting, and financial records: Retained for at least 7 years to comply with tax and accounting laws.

  • Communications: Retained for up to 7 years for legal, audit, and compliance purposes.

  • Site analytics: Retained in identifiable form for up to 26 months; aggregated indefinitely.

  • Marketing data: Retained until you unsubscribe or for 24 months of inactivity.

  • Legal hold: Information subject to legal hold or pending claims is retained until resolution.

When Personal Information is no longer needed, we securely delete, anonymize, or aggregate it.

7. Data Security

7.1 Our Measures

Rain implements reasonable administrative, technical, and physical safeguards designed to protect Personal Information from unauthorized access, use, disclosure, alteration, or destruction, including:

  • Encryption in transit (TLS) and at rest where reasonably feasible

  • Access controls and least-privilege permissions for employees and contractors

  • Multi-factor authentication for sensitive systems

  • Regular security reviews and penetration testing

  • Confidentiality agreements with employees, contractors, and Service Providers

  • Incident response procedures

7.2 No System Is Perfect

However, no method of transmission over the internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect Personal Information, we cannot guarantee absolute security. You acknowledge that you transmit information to us at your own risk.

7.3 Breach Notification

If we become aware of a security incident that affects your Personal Information in a manner requiring notification under applicable law, we will notify you and applicable authorities as required.

7.4 Your Role

You are responsible for maintaining the security of your account credentials and for any activity that occurs under your account. Notify us immediately at security@rainnetwork.co of any suspected unauthorized access.

8. Your Privacy Rights

Depending on your jurisdiction, you may have certain rights regarding your Personal Information. This Section describes the most common rights and how to exercise them.

8.1 Universal Rights We Honor for All Users

Regardless of jurisdiction, Rain will reasonably accommodate the following requests:

  • Access: Request information about the Personal Information we hold about you

  • Correction: Request that we correct inaccurate or incomplete information

  • Deletion: Request that we delete your Personal Information (subject to exceptions for legal, accounting, audit, and compliance retention)

  • Opt-Out of Marketing: Unsubscribe from marketing emails (via the unsubscribe link or by emailing privacy@rainnetwork.co)

  • Withdraw Consent: Where processing is based on consent, withdraw consent at any time

8.2 California Residents (CCPA/CPRA)

If you are a California resident, you have the following rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act:

  • Right to Know what categories and specific pieces of Personal Information we have collected, the sources, the business purposes, and the categories of third parties with whom we share.

  • Right to Delete Personal Information we have collected (subject to exceptions).

  • Right to Correct inaccurate Personal Information.

  • Right to Opt Out of Sale and Sharing for cross-context behavioral advertising.

  • Right to Limit Use of Sensitive Personal Information for purposes other than those strictly necessary to provide the Services.

  • Right to Data Portability in a portable, readily usable format.

  • Right to Non-Discrimination — Rain will not discriminate against you for exercising your CCPA rights.

To exercise these rights, contact privacy@rainnetwork.co with "California Privacy Rights Request" in the subject line. You may also use an authorized agent. We will verify your identity before fulfilling your request.

Our "Do Not Sell or Share My Personal Information" mechanism is available by sending a request to privacy@rainnetwork.co or by configuring your browser to send a Global Privacy Control signal.

8.3 Texas Residents (TDPSA)

If you are a Texas resident, the Texas Data Privacy and Security Act gives you the following rights:

  • Right to Confirm Processing and access your Personal Data

  • Right to Correct inaccuracies

  • Right to Delete Personal Data

  • Right to Data Portability

  • Right to Opt Out of: (a) targeted advertising, (b) the sale of Personal Data, and (c) profiling in furtherance of decisions producing legal or similarly significant effects

To exercise these rights, contact privacy@rainnetwork.co. We will respond within 45 days (extendable by 45 additional days where reasonably necessary). If we deny your request, you may appeal by emailing privacy-appeals@rainnetwork.co.

8.4 Other State Residents (Virginia, Colorado, Connecticut, Utah, Oregon, Montana, Iowa, Tennessee, Delaware, Indiana, New Hampshire, New Jersey, Nebraska, Maryland, Kentucky, Minnesota, Rhode Island, and Other States with Comprehensive Privacy Laws)

If you are a resident of a state with a comprehensive consumer privacy law, you may have rights similar to those described above, including the rights to access, correct, delete, port, and opt out of sale/sharing or targeted advertising.

8.5 European Residents (GDPR / UK GDPR)

If you are in the European Economic Area, the United Kingdom, or Switzerland, you have the following rights under the General Data Protection Regulation and analogous laws:

  • Right of Access to your Personal Data

  • Right to Rectification of inaccurate Personal Data

  • Right to Erasure ("right to be forgotten")

  • Right to Restrict Processing

  • Right to Data Portability

  • Right to Object to processing based on legitimate interests or for direct marketing

  • Rights Related to Automated Decision-Making including profiling

  • Right to Withdraw Consent where processing is based on consent

  • Right to Lodge a Complaint with your supervisory authority

The lawful bases on which we process Personal Data include: performance of a contract, legitimate interests, legal obligation, vital interests, public interest, and consent.

To exercise these rights, contact privacy@rainnetwork.co. Where required, we will appoint an EU/UK representative.

8.6 California Shine the Light Act

California Civil Code § 1798.83 permits California residents to request information about disclosures of Personal Information to third parties for direct marketing purposes. To make such a request, contact privacy@rainnetwork.co.

8.7 Verification and Authorized Agents

To protect your Personal Information, we will verify your identity before fulfilling rights requests. We may require you to provide reasonable proof of identity. You may use an authorized agent to make a request, but the agent must provide written authorization, and we may verify the agent's authority.

8.8 Appeals

If we deny a rights request and you believe the denial is unjustified, you may appeal by emailing privacy-appeals@rainnetwork.co. We will respond to appeals within the timeframe required by applicable law.

8.9 Limitations

We may decline rights requests where: (a) we cannot verify your identity; (b) the request is manifestly unfounded, excessive, or repetitive; (c) compliance would violate the rights of others; (d) compliance is prohibited by law; or (e) an exception under applicable law applies. We will explain any denial.

9. Children's Privacy (Strict 18+)

The Site, the Services, and Rain's business are strictly limited to adults eighteen (18) years of age or older.

Rain does not knowingly collect, solicit, or store Personal Information from anyone under eighteen. Rain does not knowingly contract with, manage, market for, or accept applications from anyone under eighteen.

If you are under eighteen, you must not access the Site, submit information, or interact with any Managed Creator through Rain channels.

If we become aware that we have collected Personal Information from a person under eighteen, we will promptly delete that information, terminate any associated relationship, and report the matter to applicable authorities where required by law (including reporting CSAM to the National Center for Missing and Exploited Children CyberTipline as required by 18 U.S.C. § 2258A).

If you are a parent or guardian and believe your child has provided Personal Information to Rain, contact us immediately at safety@rainnetwork.co.

This Site is not directed to children, and the Children's Online Privacy Protection Act ("COPPA") provisions for children under 13 are not applicable to Rain's services because we do not knowingly serve any user under 18.

10. International Data Transfers

Rain is based in the United States, and our Service Providers and operations may be located in the United States and other countries.

If you access the Site or use the Services from outside the United States, your Personal Information may be transferred to, stored in, and processed in the United States or other jurisdictions where Rain or its Service Providers operate. The data protection laws in those jurisdictions may differ from the laws of your country.

By using the Services, you consent to the transfer of your Personal Information to the United States and other jurisdictions as described.

For transfers from the European Economic Area, the United Kingdom, or Switzerland, we rely on appropriate legal mechanisms such as Standard Contractual Clauses or other lawful transfer mechanisms.

11. Sensitive Personal Information and Biometric Information

Rain may collect Sensitive Personal Information ("SPI") from Managed Creators and Applicants, including government-issued identification, biometric information used for age verification, financial account information, login credentials for platform access, and content that may depict the individual.

11.1 Limited Use

Rain processes SPI only for the purposes strictly necessary to:

  • Verify age and identity to enforce the 18+ requirement

  • Provide the Services as agreed in the MSA

  • Comply with legal obligations (including 18 U.S.C. § 2257-related record-keeping requirements where applicable to the Creator)

  • Prevent fraud and verify legitimacy

  • Defend legal claims

Rain does not use SPI for marketing, advertising, profiling, or any purpose beyond those listed.

11.2 Biometric Information

Where we collect biometric information (such as facial recognition results for age verification), we do so under contracts with reputable identity verification providers. Biometric information is retained only for as long as necessary for the verification purpose and is deleted thereafter, subject to legal retention requirements.

Texas residents: Rain complies with the Texas Capture or Use of Biometric Identifiers Act, Tex. Bus. & Com. Code § 503.001.

Illinois residents: Rain complies with the Illinois Biometric Information Privacy Act, 740 ILCS 14, where applicable to any biometric data we collect.

11.3 Your Right to Limit

California residents have the right to limit the use of SPI as described in Section 8.2. To exercise, contact privacy@rainnetwork.co.

12. Artificial Intelligence and Automated Processing

12.1 Use of AI

Rain and its Third-Party Service Providers may use artificial intelligence systems, machine learning models, and large language models in operations, including:

  • Drafting, editing, and suggesting messages, captions, posts, and replies for Managed Creator accounts (with human oversight)

  • Analyzing audience and engagement data to inform strategy

  • Automating routine customer service responses

  • Detecting fraud, abuse, and policy violations

  • Optimizing advertising performance and audience targeting

  • Generating creative content variants for Creator approval

12.2 No Sensitive Decisions by AI Alone

Rain does not use automated decision-making, including profiling, to make decisions that produce legal or similarly significant effects concerning you without human review. Decisions regarding application acceptance, contract terms, terminations, or material business outcomes involve human judgment.

12.3 AI Training

Rain does not sell Personal Information to AI providers for training their general models. Where we use AI tools provided by third parties (such as OpenAI, Anthropic, or similar), we operate under enterprise agreements that contractually restrict the use of our data for third-party model training to the extent commercially available.

12.4 Fan Communications and AI

As disclosed in Section 6 of the Terms of Service, communications on Subscription Platforms may be composed or assisted by AI tools operating under the Creator's direction. By interacting with a Managed Creator's account, you consent to this practice.

12.5 Your Rights Regarding Automated Processing

Where you have rights under applicable law to object to profiling or automated processing, you may exercise those rights as described in Section 8.

13. Marketing Communications (CAN-SPAM, TCPA)

13.1 Email Marketing

We send marketing emails only to recipients who have opted in or have an existing business relationship with us. All marketing emails include an unsubscribe link. To unsubscribe, click the link or email privacy@rainnetwork.co. We comply with the CAN-SPAM Act, 15 U.S.C. § 7701 et seq.

13.2 Text Message Marketing

We send marketing text messages only with your prior express written consent as required by the Telephone Consumer Protection Act, 47 U.S.C. § 227. Standard message and data rates may apply. Reply STOP to unsubscribe. Reply HELP for help. Frequency varies. You can withdraw consent at any time.

13.3 Phone Calls

Marketing phone calls are made only in compliance with the TCPA and Do Not Call rules.

13.4 Transactional Communications

Even if you opt out of marketing, we may still send transactional communications related to your account, application, services, or legal notices.

14. Third-Party Links, Platforms, and Services

The Site may contain links to third-party websites, platforms, applications, or services. We do not control and are not responsible for the privacy practices of those third parties.

Subscription Platforms, social media platforms, payment processors, and other third-party services have their own privacy policies. We strongly encourage you to review the privacy policy of every third party with whom you share Personal Information.

References on the Site to media outlets, news publications, or other press are descriptive only and do not constitute endorsements or partnerships, and the privacy practices of those outlets are not governed by this Policy.

15. Data Breaches

In the event of a data breach affecting your Personal Information, we will notify you and applicable authorities as required by applicable law (including state breach notification laws and the GDPR where applicable).

We are not liable for breaches caused by your own conduct, your failure to secure your account credentials, or events outside our reasonable control.

16. Changes to This Privacy Policy

We may update this Policy from time to time. When we do, we will revise the "Last Updated" date at the top of the Policy. For material changes, we will provide additional notice (such as a banner on the Site or an email notification).

Your continued use of the Site or Services after a revised Policy becomes effective constitutes acceptance of the revised Policy. If you do not agree, you must cease use.

We will not apply material changes retroactively in a manner that diminishes your rights regarding Personal Information already collected without your consent.

17. No Reliance and Integration

This Policy, together with our Terms of Service and any signed Management Services Agreement, constitutes the complete agreement regarding the collection, use, and disclosure of Personal Information.
